Recording Notification Alert

William Britton is pleased to announce the Moore County Register of Deeds office has implemented “free of charge” the Real Estate Recording Notification Service.

This service was designed to notify a person when a name is put on record. 

This service involves the following process:

  • Documents are recorded in the official records of Moore County
  • The identity being monitored is automatically sent an email at the email address provided

       (PLEASE BE AWARE THIS SERVICE APPLIES ONLY TO RECORDED DOCUMENTS AFTER SIGN-UP)

 

Additionally, citizens may request up to 10 different names or variations of names to be monitored per provided email address.

Assumed Business Name Information

 
1. The form may be obtained from any attorney, from the Business Link North Carolina Web site, or from the Register of Deeds office. 
 
     
    Select the Assumed Business Name form needed for your Business Name (Assumed Name, Amendment or Withdrawal)
 ***If this new business is an LLC or Corporation, please contact the Corporations Division of the Secretary of State’s Office at 919-814-5400.***
 
3. When the form is printed, check to make sure it complies with the recording standards for North Carolina.  The document must be on 8½” x 11” or 8½” x 14” size paper, and must have 3” blank margin at the top of the page, and ½” margin on the other three sides of the page.  Please make sure the document is typed or printed in black on white paper and font no smaller than 9 points.  It also must be only printed or typed on one side of the page.  
 

4. You may want to check the business name in the grantor index to make sure no one else is using the business name that you have selected.  This is located in Vault 1 of the Register of Deeds office or the Register of Deeds web site.  

5. Submit completed form to the Register of Deeds office in person or by mail (Register of Deeds PO Box 1210 Carthage, NC  28327).         

6. The cost to record an Assumed Name is $26.00 for the first 15 pages.  If the Assumed Name is more than 15 pages, the cost is $4.00 for each additional page.  After recording, the office will return your original document the next business day.

Maps & Plats

All condos/maps/plats are on the Register of Deeds web site from Book 1 to current. http://rod.moorecountync.gov
 
Fee to record maps/plats is $21.00 per page
 
Map Requirements:
Moore County accepts all size maps that are set out by G.S. 47-30:
  • 18”x 24”
  • A combination of 18”x 24” and 21”x 30”
  • A combination of 18”x 24” and 24”x 36”;or
  • A combination of all three sizes
The map certificate must be signed by an appointed Review Officer
OR
A certificate signed by the surveyor stating one of the following:
1. That the survey is of an existing parcel or parcels of land and does not create a
new street or change an existing street;
2. That the survey of an existing building or other structure or natural feature, such
as a watercourse; or
3. That the survey is a control survey.
 
Map requirements that do not have to meet registration requirements:
Maps of municipal boundaries and annexations
  • Highway right-of way plans
  • Transportation corridor official maps
  • Condominium plans
Maps attached to deeds or other instruments must be no larger than 8 ½” by 14”
and contain the language required by G.S. 47-30(n). An attached map that does not contain the language required must be signed by the review officer.

Redaction

 
Any person preparing or filing a document for recordation or filing in the official records may not include a social security, employer taxpayer identification, drivers license, state identification, passport, checking account, savings account, credit card, or debit card number, or personal identification (PIN) code or passwords in the document, unless expressly required by law or court order, adopted by the State Registrar on records of vital events, or redacted so that no more than the last four digits of the identification number is included.
Any person has a right to request a register of deeds to remove, from an image or copy of an official record placed on a register of deeds’ Internet Web site available to the general public or on an Internet Web site available to the general public used by the register of deeds to display public records, any social security, employer taxpayer identification, drivers license, state identification, passport, checking account, savings account, credit card, or debit card number, or personal identification (PIN) code or passwords contained in a official record. The request must be made in writing and delivered by mail, facsimile, or electronic transmission, or delivered in person, to the register of deeds. The request must specify the personal information to be redacted, information that identifies the document that contains the personal information and unique information that identifies the location within the document that contains the social security, employer taxpayer identification, drivers license, state identification, passport, checking account, savings account, credit card, or debit card number, or personal identification (PIN) code or passwords to be redacted. No fee will be charged for the redaction pursuant to such request. Any person who requests a redaction without proper authority to do so shall be guilty of an infraction, punishable by a fine not to exceed five hundred dollars ($500.00) for each violation.

Satisfaction

Satisfactions/Cancellations of Deeds of Trust & Mortgages
Effective October 1, 2005 Notice. See NC Session Law 2005-12
No fee is charged for recording Satisfactions.
G.S. 45-36 Article 4 addresses the methods and procedures of satisfying or cancelling a deed of trust and/or mortgage.
 
Methods of Satisfactions
  • Satisfactions of Security Instrument G.S. 45-36.10 Content and effect satisfaction.
(a) A document is a satisfaction of a security instrument if it does all of the following:
  1. Identifies the type of security instrument, the original parties to be security instrument, the recording data for the security instrument and
  2. the office in which security instrument is recorded.
  3. States that the person signing the satisfaction is the secured creditor.
  4. Reserved.
  5. Contains language terminating the effectiveness of the security instrument.
  6. Is signed by the secured creditor and acknowledged as required by law for a conveyance of an interest in real property.

(b) Document is a trustee’s satisfaction of a deed of trust if it complies with all of the following:
  1. Identifies the original parties to the deed of trust, the recording data for the deed of trust, and the office in which the deed of trust is recorded.
  2. States that the person signing the trustee’s satisfaction is then serving as Trustee or substitute trustee under the terms of the deed of trust
  3. Contains language terminating the effectiveness of the deed of trust.
  4. Is signed by the trustee or substitute trustee then serving under the terms of the deed of trust and acknowledged as required by law for a conveyance of an interest in real property.

(c) An affidavit of satisfaction of a security instrument must comply with all or the following:
  1. Identify the type of security instrument, the original parties to the security instrument, the secured creditor, the recording data for the security instrument, and the office in which the security instrument is recorded.
  2. State the basis upon which the person signing the affidavit is a satisfaction agent.
  3. Reserved.
  4. State that the person signing the affidavit has reasonable grounds to believe that the secured creditor has received full payment or performance of the secured obligation.
  5. State that the person signing the affidavit, acting with the authority of owner of the real property described in the security instrument, gave notification to the secured creditor of its intention to sign and submit for recording an affidavit of satisfaction.
  6. Describe the method by which the person signing the affidavit gave notification in compliance with this Article.
  7. State that:
  • More than 30 days have elapsed since the effective date of that notification, and the person signing the affidavit has no knowledge that the secured creditor has submitted a satisfaction for recording and has not received notification that the secured obligation remains unsatisfied; or
  • The secured creditor authorized the person signing the affidavit to sign and record an affidavit of satisfaction.
     8.  Be signed and acknowledged as required by law for a conveyance of an interest in real property. (2005-123, s. 1.)

Notary

The Register of Deeds office administers Notary Public oaths to Moore County notaries. When an individual has received his/her notary commission notice from the Secretary of State’s office, the individual has within 45 days to visit the Register of Deeds office to take the notary oath of office. The fee is $10.00 to administer the oath.
 
The North Carolina Secretary of State issues the Notaries Public their Notary Commission and has jurisdiction to enforce the Notary Public laws.
